Our acceptance of your cleared payment will constitute our acceptance of your order subject to our Terms Of Sale shown below.
PLEASE READ THOSE TERMS OF SALE CAREFULLY BEFORE PLACING YOUR ORDER AND RETAIN A COPY OF THESE TERMS AND DETAILS OF YOUR ORDER FOR FUTURE REFERENCE.
1Formation of the contract
1.1These terms of sale apply to all goods supplied by Moore Speed Racing Limited of Unit 12 Cortry Close, Branksome Business Centre, Parkstone, Poole, Dorset, BH12 4BQ. Registered in England and Wales, trading as Moore Speed Racing Ltd (the supplier).
1.2No contract exists between you and the Supplier for the sale of any goods until the Supplier had received your order and accepted the same by accepting your cleared payment for that order. Once the Supplier does so there is a binding legal contract between us.
1.3The contract is subject to your right of cancellation (see below).
1.4The Supplier may change these terms of sale without notice to you in relation to future sales.
2Description and price of the goods
2.1The description and price of the goods you order will be as shown on the Supplier's website at the time you place your order.
2.2The goods are subject to availability. If on receipt of your order the goods you have ordered are not available in stock, the Supplier will inform you as soon as possible and refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods.
2.3Every effort is made to ensure that prices shown on the Supplier's website are accurate at the time you place your order. If an error is found, the Supplier will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or canceling your order.
3Payment
3.1Payment for the goods and delivery charges can be made by any method shown on the Supplier's website at the time you place your order. Payment shall be due before the delivery date and time for payment shall be a fundamental term of this agreement, breach of which shall entitle the Supplier to terminate the contract immediately.
3.2There will be no delivery until cleared funds are received.
3.3Payments shall be made by you without any deduction whatsoever unless you have a valid court order requiring an amount equal to such deduction to be paid by the Supplier to you.
4Delivery
4.1The goods you order will be delivered to the address you provide when placing your order, subject to the Supplier's delivery restrictions.
4.2If delivery cannot be made to your address due to unforeseen circumstances or delivery restrictions, the Supplier will inform you as soon as possible, and you may need to provide an alternative delivery address or collect the goods from a designated location.
4.3Any delivery timescales provided are estimates only and are subject to postal delays or force majeure events. The Supplier shall not be liable for any delay in delivery.
4.4Upon delivery of the goods, you may be required to sign a delivery receipt. It is your responsibility to ensure that the delivery is accurately received and any discrepancies or damages are reported to the Supplier immediately.
5Risk and Ownership
5.1The risk of damage or loss of the goods shall pass to you upon delivery or attempted delivery.
5.2Ownership of the goods shall not pass to you until the Supplier has received full payment for the goods, including any applicable delivery charges.
6Warranty and Liability
6.1The Supplier warrants that the goods will be of satisfactory quality, fit for their intended purpose, and in accordance with any description provided.
6.2To the extent permitted by law, the Supplier shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, loss of business, or loss of data, arising out of or in connection with the use of the goods.
6.3The Supplier's liability in respect of any defect in the goods shall be limited to the replacement or repair of the defective goods or a refund of the purchase price, at the Supplier's discretion.
6.4You are responsible for ensuring that the goods are suitable for your intended use and for following any instructions or guidelines provided by the Supplier.
6.5Any claim for defective goods or refund must be made within a reasonable time from the date of delivery. You may be required to provide proof of purchase and evidence of the defect.
6.6The Supplier shall not be liable for any damage or defect caused by normal wear and tear, misuse, alteration, or improper handling of the goods.
7Termination
7.1Either party may terminate this agreement by giving written notice to the other party in the event of a material breach that is not remedied within a specified timeframe.
7.2Upon termination, you must cease using the goods and return any unused goods to the Supplier, unless otherwise agreed upon.
7.3Termination of this agreement shall not affect any rights or liabilities that have accrued prior to the termination.
